To gain approval to accept grant funding offered by the Department of Work and Pensions (DWP).
The council has successfully applied to DWP to be a gateway organisation for the delivery of the Kickstart scheme across Herefordshire. As part of the Covid 19 recovery programme, the Kickstart scheme funds 6 monthly work experience placements for 16 to 24 year olds receiving universal credit.
An urgent decision is required to accept and implement this scheme to meet the DWP deadline to accept the grant by 4 February 2021 as part of the Covid 19 response.

During the unprecedented situation facing
businesses across Herefordshire it has identified that there is a
need to provide additional tailored 121 business support to
businesses, especially as current Business Support Staff are
focussed on delivering Covid-19 Business Support Grants.
The council have conducted a procurement exercise to form a
framework of suitable suppliers of business support to deliver the
service to businesses across the county. Given the expected high
demand for the service it was decided a framework approach would
provide more capacity rather than a single supplier.
The procurement exercise concluded that three companies had the
required skills, experience and staff capacity to undertake the
commission and could be included within the framework.
The funding for this framework has been provided by the Marches LEP
via the existing Growth Hub project. The LEP has agreed that the
funding should only be made available for the provision of these
advisory services.
The service will be promoted via the Marches Growth Hub and the
council, both organisations will promote on their website and
social media channels and will produce suitable publicity.
Businesses applying to the service will be allocated a supplier on
the basis of supplier capacity and the nature of the business
requiring support, this will give businesses the most appropriate
advice for the nature of their enquiry.

27/01/2021 - Approval of Main Contract budget and Furniture Fixtures and Equipment budget to finance the fit out of the Shell Store – January 2021 ref: 7582 Recommendations Approved
The Shell Store incubation centre project has
materially completed construction, the building was handed over to
the council in September 2020. There are currently a number of
snagging and small scale works being undertaken on the building by
the main contractor, Barnwood.
Barnwood and Mace, as the council’s appointed project
manager, are liaising in relation to these snagging and small scale
works.
In August 2020 a decision was taken to approve budget expenditure
against a number of items including the allocation of £50,000
from the Fixtures, Fittings and Equipment budget towards the
procurement of items to fit out the Shell Store café and
reception areas. The works to the café and reception are now
materially completed.
There is a need to undertake the fit out and installation of a
number of other items within the building that will be material to
its operation and marketability.
These works include relatively significant expenditure on
telecommunications equipment alongside several, more minor work
requirements.
The telecommunication works requires the installation of
communication equipment and wifi to serve all the separate offices
and the associated support facilities – meeting rooms and
reception. New communication equipment is required to make the
links from the fibre input to the Shell Store comms room and all
the individual rooms. This will enable each tenant to have their
own secure connection and their data usage can be monitored and
charged for.
Additional work is required on the wifi network to ensure that it
is available throughout the building and that occupants can move
from office to atrium and other spaces with the same connectivity
and security. The cost for undertaking this work is estimated by
ITS, the Enterprise Zone communications contractors, to be:
£135,000.
This work is considered essential for the building to be able to
attract the high quality businesses that form the target occupants.
Given the specialist technical requirements required to install the
wifi network the work is outside the specification of the main
contract budget. Inclusion of high quality communications within
the building was a consideration within the business case and the
project budget of £7.315m. This work will not lead to an
extension of the existing project budget and can be managed within
existing budget lines as demonstrated in the finance section below.
The Programme Board recommended that a detailed and separate
procurement exercise is completed to commission this work and a
delegated budget of £135,000 is set aside for this
purpose.
In addition to this relatively significant expenditure Mace have
advised that a certain amount of fit out of the atrium and public
areas of the building will be required, this has been confirmed
with operators of similar facilities. There is a collective need to
purchase items such as, but not limited too, security lockers for
users, TV’s for use in the reception heritage pod, and public
areas, furniture to facilitate ad hoc meeting space within the
atrium, furniture to equip meeting spaces, furniture for the
conference facility etc. An appropriate procurement exercise will
be undertaken to purchase each of these, and any other, required
items.
Individually many of these items will be at a relatively low value
and requiring individual budget approvals for each is not
considered an appropriate use of officer resource. It is
recommended that £50,000 from the Shell Store fixtures,
fittings and equipment budget is delegated to the Project Manager
in consultation with the spend manager against the above listed
items, and any others that the Project Manager and Project Lead
considers appropriate.
The building has the infrastructure to accommodate up to four
electric vehicles charging points, the charging points themselves
are not yet installed and were outside the scope of the
construction commission. The installation of the charging points
will assist in the achievement of BREEAM points which determines
the overall BREEAM rating of the building. Estimated cost for the
installation of two chargers providing four charging points is no
more than £10,000. The Programme Board recommend that a
suitable procurement exercise is undertaken to install the charging
points and that a budget of £10,000 is set aside for this
purpose from the Fixtures Fittings and Equipment Budget.
Approval of expenditure against budget will based on
recommendations from the Shell Store Project Manager/Project Lead,
and where appropriate consultation with the Programme Board.

Safeguard an existing Herefordshire business in the county and
facilitate its further expansion.
Deliver private sector investment and job creation in the EZ which
will boost confidence and interest from others and help generate
further private sector investment and job creation. Speedy
occupancy will boost the rates relief pot for the Local Enterprise
Partnership (and hence the council).
Following the award of enterprise zone status in August 2011
approximately 45 hectares (110 acres) of council owned land was
included, along with other privately owned land, in the designated
EZ. The EZ status has resulted in the council and occupiers within
the EZ benefiting from a number of government incentives such as
significantly increased awareness and profile of the location and
opportunity, business rates relief and retention, improved access
to broadband etc. These factors have resulted in an increase in
interest from local, national and international businesses in
active and advanced negotiations with the council to acquire land
within the EZ.
This area of land is located centrally within the EZ and has been
identified for general employment use.
The sale of the land is on a freehold basis. The purchaser will not
accept or proceed with the purchase on any other basis.
All the EZ land is being actively marketed, and is being sold
according to independent land valuations and the EZ Land Disposal
Policy which was approved by cabinet member on 7 January 2016. The
agreed purchase price meets the market valuation. Valuation

This sale has the full endorsement of the EZ executive board.
The sale is to a local business whose current premises are no
longer sufficient for their needs. They now wish to build their own
premises to enable their expansion and the ability to expand the
workforce.
The purchaser and their proposal have been assessed by the Hereford
Enterprise Zone Board and deemed to meet the Placement Strategy,
the Board’s set of criteria which each oncoming business must
achieve in order to progress onto the Enterprise Zone.
The business was assessed to have met the Placement Strategy
through its job creation predictions (in excess of 30% over 3
years) and being within one of the Enterprise Zone’s priority
sectors (advanced engineering).
The decision to sell this plot supports council policy to use
capital receipts from sale of land within the Enterprise Zone to
fund the capital expenditure on installing necessary infrastructure

The Public Realm contract (September 2013
– August 2024) provides for the monitoring and reporting of a
set of Strategic Performance Indicators (SPIs), with performance
initially being self-assessed by the provider, Balfour Beatty
Living Places followed by an audit undertaken by the
Council’s Contract Management Team.
The contract model enables extension to the contract period for
achieving acceptable strategic performance and total performance
scores in each financial year.
The First SPI additional years review decision was taken in May
2018 and awarded a contract extension of 1 year to August
2024.
This second review concerns the subsequent three financial years
namely financial years 17/18, 18/19 and 19/20 as detailed in Clause
31.1 -31.7 of the contract.
As part of this review, an independent assessment of the Contract
Management Team’s findings is required in order to assure
impartiality and correctness of the findings.
To secure an independent body to undertake this independent
assessment, CMT have tendered through the Councils Portal. Three
expressions of interest were received and one completed tender. The
completed tender was deemed compliant. VFM is assured by comparison
with the previous independent verification exercise undertaken in
2018.
The tender in 2018 was for one year’s worth of data
assessment and was priced at 64% of this assessment. This
assessment is for three years data, so value is assured by
comparison
Following the tender process the contract for this work will be
awarded to HKA and the cost of this commission of £4,200 will
be funded from existing public realm budget (C07192)

£7.674M of funding, some of which was initially earmarked to

An initial programme of works on which this funding would be spent
was developed and set out in a record of officer decision dated 17
September 2020 and this set out the programme of projects as

Environment Agency on the ability to enter the water course to

Whilst design work and procurement of prefabricated elements of the
projects will be undertaken in 2020/2021 construction work cannot
commence until 2021/2022 as a result of the constraints above. This
results in a forecast anticipated underspend in 2020/20211 of
£1.641M on those elements affected by entry into the water
courses with respect to the pothole and challenge budget, and for
the same reason £245K with respect to the HAM funding
In order to deliver the intended agreed programme of projects set
out above the schemes will now be delivered from the councils
Investment in C & U roads capital budget next financial year,
and the C and U roads work that was to be delivered from that
budget will be undertaken this financial year funded from the
pothole and challenge fund grant money.
These works can be funded from that highway maintenance grant
funding.
The HAM funding of £245K is to be carried forward into
2021/2022 to align with the new programme requirements

To approve a capital grant to Citizen Housing for improvement works to enable the launch of a homelessness hub in Hereford, with an associated nominations agreement.
The proposal forms part of Project Brave, an initiative developed during the Covid19 response and now evolving to make homelessness in Herefordshire rare, infrequent, non-recurring and short-lived.
It is proposed to make a grant of capital to Citizen Housing to enable redecoration and refreshment of the accommodation located west of the City Centre. The grant for works to create a homelessness hub will be funded entirely from a capital grant awarded for the purpose to the council by the Ministry of Housing, Communities and Local Government (MHCLG)
The hub will launch during April 2021 and provide drop-in advice and support, eight units of emergency accommodation and four self contained flats for transition of homeless people towards independent living. Support and advice will be provided by the council's Housing Solutions service and Vennture, with housing management through Citizen Housing. There will be a nominations and operational agreement between the three organisations to support smooth and effective accommodation and support of homeless people at the hub.

trace support payments scheme on 20 September 2020 and an extension
to the scheme was announced on 11 January 2021.
Central government is providing further funding for Test and Trace
Support Payments of a £500 lump sum payment for employed
people on low incomes who are unable to work while they are
self-isolating because they cannot work from home.
To be eligible for the Test and Trace Support Payment, an
individual must:
? have been asked to self-isolate by NHS Test and Trace either
because they’ve tested positive for coronavirus or have
recently been in close contact with someone who has tested
positive;
? be employed or self-employed;
? be unable to work from home and will lose income as a result;
and
? be currently receiving Universal Credit, Working Tax Credit,
income-based Employment and Support Allowance, income-based
Jobseeker’s Allowance, Income Support, Housing Benefit and/or
Pension Credit.
To be eligible for a discretionary Test and Trace Support Payment,
an individual must:
? have been asked to self-isolate by NHS Test and Trace either
because they’ve tested positive for coronavirus or have
recently been in close contact with someone who has tested
positive;
? be employed or self-employed and earn up to £400 a
week;
? be unable to work from home and will lose at least 50% of earned

Discretionary Grant Scheme
Following the Cabinet Member decision on 24 November 2020, a
Discretionary Grant Scheme was launched to help those businesses or
charities affected by the November 2020 lockdown period. The scheme
provided support to those businesses mandated to close but without
a rateable value who would not receive a grant via the Local
Restrictions Support Grant and those that were open but lost more
than 50% of trade.
The council will now re-launch the Discretionary Support Scheme to
assist those businesses or charities closed due to the lockdown
period which commenced on the 5th January where ineligible for the
Local Restrictions Support Grant.
The changes to the Discretionary Grant Scheme are as follows;
• Support of between £1,334 and £3,000 will be
provided to businesses mandated to close in the lockdown period
which commenced on the 5th January but are not eligible for the
Local Restrictions Support Grant (LRSG). To ensure alignment with
the LRSG for those businesses that successfully apply, a rolling
monthly grant award will be made to these businesses for the period
of lockdown (pro-rated where the lockdown is less than one full
month).
• Businesses that were closed in November 2020 and
successfully applied for the Discretionary Grant Scheme will also
now receive a monthly equivalent payment for the latest lockdown
period (subject to confirmation they remain closed but have not
gone out of business).
• The revised Discretionary Grant Scheme will no longer
provide support to businesses that are open and lost more than 50%
of trade. These businesses will be supported by the Exceptional
Circumstances Fund below.
• In accordance with the move to a regular payment, the Head
of Economic Development or the Economic Development Manager will be
authorised to approve a grant award of up to £3,000 per
business per month for the period of the national lockdown.
• Registered charities must have an income of more than
£5k per annum
Exceptional Circumstances Fund
On the 5th January 2021 the government announced a ‘top
up’ grant scheme to support Retail Hospitality and Leisure
businesses with a rateable value of between £4,000 and
£9,000 (in addition to the LRSG funding).
Recognising that a number of Retail, Leisure and Hospitality
businesses do not have a rateable value, and that a number of other
businesses sectors have been severely impacted by the lockdown, the
council will utilise the Additional Restrictions Grant allocation
to establish an Exceptional Circumstances Fund (ECF) to support
those that have lost more than 50% of trade. Aligned to the Retail
Hospitality and Leisure grant award levels, the ECF will make grant
awards on a sliding scale subject to the level of losses incurred
and the size of the respective business (in terms of FTEs
employed).
The ECF will be available to Herefordshire based self-employed,
micro, small businesses as well as registered charities who were
trading on or after 5th January 2021 who wish to make a case for
why a grant is critically required based on the following
circumstances;
• They are not eligible for the Retail Hospitality and Leisure
‘top up’ grant and can demonstrate a significant (50%+)
loss of income. Businesses and charities that have received either
the Discretionary Grant Scheme, Local Restrictions Support Grant,
or the Self-Employed Income Support Scheme (SEISS) that have not
received the Retail Hospitality and Leisure top up grant and can
demonstrate significant on-going financial hardship will be able to
apply for the ECF.
• They employed at least half of one full time equivalent
employee on 5th January 2021 within Herefordshire. That is someone
who works at least 15 hours per week for the business. This can
include the business owner(s) or the director(s) of a limited
company if they work for the business or charity. Registered
charities can include evidenced volunteer time for this eligibility
(up to 4 FTE volunteers)
The minimum grant level that will be paid (please see levels below)
will be £2,000 or less if the level of declared lost income
is lower than this amount (net any other grant award). This would
prevent businesses or charities from possibly inadvertently
profiting from the scheme, by ensuring they receive a grant within
levels of losses actually incurred.
Those who would like to be considered for the ECF will complete an
online application form to set out their case (declaring their
application to be a true and accurate account), and provide any
available supporting evidence to their application such as a
statement from their accountant of the impact on their business,
letter from bank manager, evidence of cancelled orders/ events,
identifying numbers of employees on payroll who are now at risk of
redundancy.
A decision making panel (senior Economic Development and Finance
managers) will review applications on their own merits making a
recommendation to the Head of Economic Development or the Economic
Development Manager to award a grant award of £0, £2K
£4K, £6K or £9K (or within these bandings in line
with the level of loss incurred). This level of grant award is
aligned with the Retail Hospitality Leisure top up scheme, but
including a lower threshold of £2,000 (or below in line with
level of lost income) for sole traders or micro businesses/ smaller
charities.
The ECF will provide one top up payment to eligible businesses for
the current lockdown period. Should the period of lockdown be
extended, and second proportionate (subject to the length of the
extension) payment may be made.
In an exceptional circumstance, where a business or charity
operates from multiple sites and can demonstrate that their future
viability is at significant risk, the panel may make a
recommendation to the Head or Economic Development or the Economic
Development Manager to consider awarding multiple grants.
As a guide the following scoring criteria would utilised by the
panel.

individual grant would not exceed £9,000.
Where the number of applications received exceeds the available
budget, the council reserves the right to proportionately reduce
the grant award to within the available funding.

unprecedented threat to Public Health posed by the outbreak of
COVID-19.
Government has directed all secondary schools to conduct lateral
flow testing for pupils and teachers upon their return to school in
January 2021.
Waste from these tests has been classified as
‘healthcare’ waste which must be collected and disposed
of as prescribed by the Department of Health and Social Care
Clinical Standard Operating Procedure (SOP) for Mass Testing with
Lateral Flow Antigen Testing Devices in Schools and Colleges
version 2.2. This prescribes that the waste has to be collected
separately from normal general rubbish.
Schools are advised to contact their existing waste collection
provider for a collection service. Herefordshire Council provide a
general waste collection service to the majority of schools.
A clinical waste collection service is currently only provided to
households across the county but our collection contractor have the
specialist vehicle required to transport ‘healthcare’
waste safely between schools and a disposal point.
Our Energy from Waste facility has received approval from the
Environment Agency to accept specified non-hazardous healthcare
waste associated with LFT under Regulatory Position Statement
C23.
The collection cost for the service is outlined in the existing
bill of quantities under the Waste Collection Contract.
The disposal cost of the healthcare waste will be charged through
the existing cost of contract waste under the Waste Management
Service Contract.
The councils charging principle seeks to achieve full cost recovery
for delivering services where it is appropriate to do so, unless
there are conflicting policies, legal or contractual reasons not to
do so. The cost charged to schools for this service therefore
incorporates both the collection and disposal costs which the
council will incur from its contractors.
The cost charged by the council to schools for this service will be
£6.78 per sack collected with an additional one off cost of
£20.28 for delivering the first sacks directly to the
school.

Significant remediation work has already taken
place on the North Magazine, including extensive ground
investigations and earth movement/sifting in preparing the site for
further development. Detailed design work for the required
infrastructure has now also been completed following the
masterplanning exercise carried out in Summer 2020.
The council is now ready to commence the construction phase at the
North Magazine following a successful tender exercise which will
include the installation of the estate roads, utility trenches,
SUDS, foul drainage, walkways / cycleways and landscaping features.
The work will see the North Magazine sub-divided into a number of
smaller plots in line with identified investor interest.
Owen Pell Limited have been appointed following an open tender
exercise which was carried out via the pro contract system, and
evaluated against both cost and quality. The council’s
contract procedure rules have been followed with support from the
commercial team.

3) Due to further unexpected vandalism the extent of work needed at
the Pembridge site has increased since the original survey which
informed the scope of Project 1. All 6 plots are now known to be in
need of modernisation, rather than the 2 plots previously intended.
There is insufficient funding within the Project 1 budget to
address all 6 plots, and a high risk that vandalism and rubbish
accumulation will continue if only 2 plots are modernised leaving 4
nearby plots vacant and uninhabitable. A future project with
sufficient funding to refurbish and let all 6 plots would be
expected to represent greater value for money and a more robust use
of funds.
4) Unauthorised encampments at Pembridge are currently preventing
progression of the work at this site, and it is not at this stage
clear when this work would be able to proceed.
5) Pembridge is expected to see investment during 2021/22 in 4
brand new traveller sites on a separate area as set out in (d) of
the cabinet report (Project 2).

• The council faces challenges in finding accommodation for
vulnerable people with complex needs as social housing providers
prioritise commercial considerations and are often unwilling to
take the risk of letting homes to this user group. Consequently the
council needs to find alternative accommodation solutions which are
economic and sustainable.
• One of the buildings to be let was purchased by the Council
last year to provide supported accommodation for vulnerable people
with complex needs. The other property is residential stock that
was already owned by the Council. Decision to purchase was a
partially exempt decision as the property will house vulnerable
people. Consequently property details are included in Appendix
1.
• The Properties (both in Hereford City Centre) will
accommodate in total eight very vulnerable care leavers to improve
outcomes and help prevent specialist high cost placements.
• The tenant was selected by competitive tender to provide
