To consider an application for a new premises licence in respect of the ‘New Inn, Ledbury Road, Bartestree, HR1 4BX’.

The sub-committee considered a new premises license in respect of the New Inn, Ledbury Road, Bartestree HR1 4BX

The Chairman read out the guidance notes and asked all parties to introduce themselves.

The licence officer presented the report as per the agenda papers.

It was noted that the Police and Trading Standards submitted conditions had been approved.

The subcommittee heard from the applicant Mr Reynolds who confirmed that 200 local residents had signed a petition to reopen the premises as a hotel. Mr Reynolds confirmed that there was no plan to turn the premises in to a night club.

The sub-committee retired to make its decision. On its return the legal advisor read out the decision.

DECISION

 

This is an application for a new premises licence in respect of the New Inn Bartestree.

 

The regulatory subcommittee has decided to grant this application in the terms on which it is drawn.

 

 Note: the committee supports the application to reopen these premises and wishes it well.

To consider an application for a new premises licence in respect of the ‘Crown & Sceptre, 7 Sherford Street, Bromyard, HR7 4DL’.

The sub-committee considered a new premises license in respect of the Crown and Sceptre, 7 Sherford Street Bromyard HR7 4DL.

The Chairman read out the guidance notes and asked all parties to introduce themselves.

The licence officer presented the report as per the agenda papers.

It was noted that all representation made by responsible authorities had been agreed with the applicant.

Mr Roger Page, representing the applicant confirmed that the applicant had taken up the freehold some time ago but had given up the premises licence. The applicant had up until recently been trading on temporary event notices (tens) however the allocation for tens had been exhausted and therefore the premises had effectively been closed for the last two weeks. The applicant believed that all matters had been addressed including resident’s views and that responsible designated premises supervisors will be employed and will receive suitable training.

Mr Bartrop, representing residents, was pleased that conditions had been agreed and confirmed that representation submitted on behalf of residents would be withdrawn and wished the applicant success for the premises.

The Chairman asked all present if there were any further comments in relation to the application. There were no further comments and the sub-committee retired to make its decision.

On its return the legal advisor read out the decision.

 

This is an application for a new premises licence in respect of the Crown and Sceptre, Bromyard

 

The regulatory subcommittee has decided to grant the application on the basis of the revised hours as noted on papers and 46 and 47 of our papers. The committee notes that the licensing conditions have been agreed.

 

The committee compliments both the applicant and the objector’s representative for their mutually supportive approach to issues that have been of concern.

To consider an application for a new premises licence in respect of the ‘Kubus Polski Sklep, 22 Eign Gate, Hereford, HR4 0AB’.

The sub-committee considered a new premises license in respect of the Kubus Polski Skep, 22 Eign Gate, Hereford HR4 0AB.

The chairman read out the guidance notes and asked all parties to introduce themselves.

The licence officer presented the report as per the agenda papers.

The Chairman offered the opportunity for all present to raise any points regarding the agenda papers.

The licence officer confirmed that the applicant had been sent the relevant documents relating to the hearing by post and email on the 16 May 2016. The applicant was asked to confirm her postal and email address which corresponded with the contact details used by the licence officer on the 16 May 2016.

The applicant’s solicitor stated that the applicant had first has sight of the agenda papers on Saturday 28 May and had then contacted her solicitor.

The legal officer to the committee suggested that they retire to consider the issue of correspondence before proceeding with the hearing.

The subcommittee retired to consider the issue of correspondence.

Decision

 

This is an application for a new premises licence in respect of the Kubus Polski Sklep, 22 Eign Gate Hereford.

 

The committee has considered as a preliminary point whether the papers served on the applicant were indeed properly served or served at all.

 

The committee has found that on the balance of probabilities the papers prepared by the council’s licensing department were properly served on the applicant by both email and post.

 

However, the committee takes note that the applicant has very recently taken legal advice and retained a solicitor. In the interests of justice and that she should be fairly represented the committee agrees to adjourn the application until Monday 20th June 2016 at 14:00hrrs
