Members of the licensing sub-committee from the Council’s Planning and Regulatory Committee considered the above application, full details of which appeared before the members in their agenda.

 

Prior to making their decision the Council’s Licensing Officer presented the report which outlined the options available to the sub-committee. Two representations had been received from the responsible authorities, Trading Standards and the Local Authority; the set of conditions proposed was accepted by the applicant. One relevant public representation had been received.

 

The sub-committee then heard from the applicant’s representative that:

 

·         The applicant sought to operate a shop with reasonable hours consistent with a typical convenience store;

·         The representations and conditions proposed by Trading Standards and the Local Authority had been accepted;

·         The applicant would have sought to engage with the member of the public responsible for the representation to attempt to resolve any issues. It was unfortunate that the representation was received late into the consultation period which prevented this approach;

·         There had been no other representations from occupiers of immediate properties concerning the potential for a noise nuisance posed by the application; and

·         There would be very little activity in and around the shop late at night to cause a noise nuisance.

 

Following questioning by the sub-committee it was confirmed that:

 

·         The applicant lived in the property immediately above the shop;

·         No representations on the application had been received from any members of the public who were resident in the immediate vicinity of the shop; and

·         The opening hours proposed in the application were consistent with those of a restaurant that had operated from the premises previously.

 

 

 

 

 

The sub-committee carefully considered all the representations, reports and evidence before them. They have had regard to their duties under S4 of the Licensing Act and considered guidance issued under s182 of the Licensing Act 2003 and Herefordshire Council’s Statement of Licensing Policy 2020 - 2025. 

 

DECISION

 

The sub-committee’s decision is to grant the application as applied for with the additional conditions which were put forward by Trading Standards and the Local Authority and agreed by the applicant.

 

REASONS

 

The sub-committee has considered the written representation from a member of the public, in particular item 3, and the information presented to the sub-committee. The sub-committee consider that the application with the addition of the above mentioned conditions will promote the licensing objectives.
