To consider an application for review of a premises licence following the expedited/summary licence review in respect of ‘Supersam, 141-143 Eign Street, Hereford, HR4 0AJ’ called by Sergeant 3456 Duncan Reynolds of the West Mercia Police.

The meeting was adjourned for 10 minutes to allow for the arrival of the interpreter.

 

Members of the regulatory sub committee of the council’s regulatory committee considered the above report, details of which appeared before the Members in their agenda and the background papers.

Prior to making their decision the Members heard from Inspector Nick Semper representing West Mercia Police who reminded the committee that they would be hearing evidence which may be used in any potential future prosecution of the premises licence holder.   

 

RESOLVED

 

a)         That under Regulation 14 of the Licensing Act 2003 that the meeting be closed to members of the public and press. 

 

b)        The committee have considered the likely impact on the financial personal circumstances of the premises licence holder but given the seriousness of the criminal activity it is considered that only revocation of the licence in these circumstances is warranted, appropriate and proportionate to prevent the undermining of the crime and prevention objective.   

 

c)         The committee have also considered the interim steps and having regard to the evidence presented to committee consider that the suspension of the licence should remain in place pending the outcome of any appeal.

To consider an application for review of a premises licence following the expedited/summary licence review in respect of ‘Mila, 102-104 Belmont Road, Hereford, HR2 7JS’ called by Sergeant 3456 Duncan Reynolds of the West Mercia Police.

Members of the regulatory sub committee of the council’s regulatory committee considered the above report, details of which appeared before the Members in their agenda and the background papers.

In the opinion of the Proper Officer, the following item will not be, or is likely not to be, open to the public and press at the time it is considered.

 

RECOMMENDATION:         that under section 100(A)(4) of the Local Government Act 1972, the public be excluded from the meeting for the following item of business on the grounds that it involves the likely disclosure of exempt information as defined in Schedule 12(A) of the Act, as indicated below and it is considered that the public interest in maintaining the exemption outweighs the public interest in disclosing the information.

 

1          Information relating to any individual.

 

2          Information which is likely to reveal the identity of an individual.

 

Minutes:

Under section 100(A)(4) of the Local Government Act 1972, the public was excluded from the meeting for the following item of business on the grounds that it involves the likely disclosure of exempt information as defined in Schedule 12(A) of the Act, as indicated below and it is considered that the public interest in maintaining the exemption outweighs the public interest in disclosing the information.

Application to re-instate an expired hackney carriage vehicle licence H196 outside standard condition 11.5

To decide whether to licence a vehicle outside the standards vehicle licence conditions.

Minutes:

The applicant had given apologies to the committee due to sickness.   The committee agreed that the application would be deferred to the next committee meeting.

 

RESOLVED

 

That the application be deferred to the next meeting of the regulatory sub committee.

Application to deviate from standard hackney carriage vehicle licence condition 10.1(c)

To decide whether to licence a vehicle outside the standards vehicle licence conditions.

Minutes:

With the agreement of the applicant, it was agreed that the application would be deferred until the next meeting.
