EXPEDITED/SUMMARY LICENCE REVIEW OF THE PREMISES LICENCE: SUPERSAM, 141-143 EIGN STREET, HEREFORD, HR4 0AJ - LICENSING ACT 2003 pdf icon PDF 372 KB

To consider an application for an ‘expedited licence review’ of the premises licence relating to ‘Supersam, 141-143 Eign Street, Hereford, Herefordshire, HR4 0AJ’ called by Sergeant 3456 Duncan Reynolds of the West Mercia Police.

Members of the Regulatory Sub Committee of the Council’s Regulatory Committee considered the above application, full details of which appeared before the Members in their agenda and the background papers.

The premises licence holder had been informed orally and in writing of the meeting but was not in attendance and the committee therefore elected to proceed.

Prior to making their decision the Members heard from Sergeant Duncan Reynolds and Jim Mooney representing West Mercia Police; and Mr Fred Spriggs, Licensing Officer Herefordshire Council.  Those representations disclosed information about serious crime, namely evasion of duty and tax, being directly associated with the premises.  Non duty paid cigarettes and alcohol  were found on the premises as was information that led to the seizure of a large quantity of similar goods in a nearby location.

 

Having carefully considered those matters brought before them and in reaching their decision, the Members had full regard to both the provisions of the Licensing Act 2003 (as amended by the Violent Crime Reduction Act 2006), the Guidance Issued under Section 182 and the guidance issued under Section 53A of the Licensing Act 2003 as amended and the Council’s Licensing Policy. 

 

DECISION

 

Hearing of the regulatory subcommittee held on 29 November 2016 in respect of an expedited review of the licenced premises known as Supersam, 141-143 Eign Street, Hereford, HR4 0AJ.

 

Having heard a summary of the evidence and received a report from the Council’s Licensing officer the committee has taken the interim step of suspending the licence for the above premises.   This interim step was considered appropriate given the need to promote the licensing objectives and in particular the prevention of crime and disorder pending a full review.   The interim steps will be reconsidered at the review hearing and may be extended until the outcome of any appeal.   This interim step takes immediate effect. 

 

This matter will be further considered at a review hearing on 15 December 2016 at 2.00 pm.

To consider an application for an ‘expedited licence review’ of the premises licence relating to ‘Mila, 102-104 Belmont Road, Hereford, Herefordshire, HR2 7JS’ called by Sergeant 3456 Duncan Reynolds of the West Mercia Police.

Members of the Licensing Panel of the Council’s Regulatory Committee considered the above application, full details of which appeared before the Members in their agenda and the background papers.
