To consider an application for the variation of a premises licence in respect of the ‘Queens Head, 51 Bridge Street, Kington, HR5 3DW’.

The sub-committee considered an application for a variation of a premises licence at the Queen’s Head, 51 Kings Street, Kington.

 

The chairman read out the guidance notes and asked all parties to introduce themselves.

 

The council’s legal adviser confirmed to the applicant that legal advice was available if required and drew the committee’s attention to the application before them and in particular the minor alteration made to the agenda papers.

 

The licensing officer presented the report as per the agenda papers before the committee.

 

The legal adviser highlighted the requirement of Thwaites where it states that any conditions placed on the licence must be evidence based.

 

The licencing officer confirmed to the committee that the applicant had offered a number of conditions in respect of the licence.

 

The applicant confirmed that he did not wish to upset neighbours and that live music would not be a regular occurrence

 

The chairman commented that it had been noted that the applicant had listened to representations and had reduced hours accordingly.

 

The sub-committee retired to make its decision. On its return the legal advisor read out the decision.

Resolved

 

It is the decision of the Regulatory Sub Committee that:

 

The regulatory sub-committee on 18 March 2016 made this decision in respect of an application to vary the premises licence in respect of the Queen’s Head, 51 Bridge Street, Kington HR5 3DW.

 

1.    The committee grants this application on the basis of the amendments proposed by the applicant subject to the conditions offered by the applicant and agreed by the licensing manager as shown in pages 33 to 35 inc. of the report.

 

2.    The amended licensing hours are that the premises may be licenced for live music, recorded music and the supply of alcohol from midday to 01:00 a.m. on the evenings of friday, saturday, sunday, and the nights of bank holiday mondays only. Otherwise the present licensing hours as shown at paragraph 6 of the report on page 12 shall continue.

 

3.    The committee was presented with real evidence in support of the application’s conditions as required by the Thwaites case decision which the committee duly noted.
