To consider an application for the Grant of a premises licence in respect of Luminescence.

Members of the Council’s Regulatory Sub Committee considered the above application, full details of which appeared before the Members in their agenda.

 

Prior to making their decision the Members heard from Ms C Corfield, Licensing Team Manager Herefordshire Council, Mr J Mooney representing West Mercia Police;  Mr N Coulson representing the applicant and Ms Lauren Waring the applicant.

 

Having carefully considered those matters brought before them and in reaching their decision, the Members had full regard to both the provisions of the Licensing Act 2003 (as amended by the Violent Crime Reduction Act 2006), the Guidance Issued under Section 182 and the guidance issued under Section 53A of the Licensing Act 2003 as amended and the Council’s Licensing Policy. 

 

DECISION

 

It is the decision of the Regulatory Sub Committee that:

 

The Regulatory Sub Committee has considered the application for a new premises licence at 25 Widemarsh Street, Hereford.

 

  1. The Committee grants this application – it having been persuaded that notwithstanding the premises are located within the Hereford Cumulative Impact Zone the presumption that the application be refused has been rebutted successfully by the applicant and her representative.

 

  1. The sub-committee has considered carefully the conditions as offered by the applicant on pages 34 – 39 of our bundle as commented upon and recommended in part by both the police (at page 51) and the Trading Standards Officers ( pages 53 and 54).

 

      The committee requires the Licensing manager to prepare a full schedule of            conditions reflecting all of the above. The Committee however proposes that           police condition 11 be extended from 23:30hrs to midnight.

 

 

  1. Subject to the above, the sub-committee stresses, for the avoidance of doubt, that as offered by the applicant (at point 8 on page36) no admission of customers will be allowed onto the premises after 0130hrs on all seven days of the week. It also requires that this condition be sufficiently enforced.

EXCLUSION OF PUBLIC AND PRESS

In the opinion of the Proper Officer, the following item will not be, or is likely not to be, open to the public and press at the time it is considered.

 

RECOMMENDATION:         that under section 100(A)(4) of the Local Government Act 1972, the public be excluded from the meeting for the following item of business on the grounds that it involves the likely disclosure of exempt information as defined in Schedule 12(A) of the Act, as indicated below and it is considered that the public interest in maintaining the exemption outweighs the public interest in disclosing the information.

 

1          Information relating to any individual.

 

2          Information which is likely to reveal the identity of an individual.

APPLICATION TO RE-INSTATE AN EXPIRED HACKNEY CARRIAGE VEHICLE LICENCE OUTSIDE STANDARD CONDITION 11.5

To decide whether to licence a vehicle outside the standards vehicle licence conditions
