Regulatory Sub Committee was convened in order to determine an application for the review of a Premises Licence in respect of Champagne Signature, 14-15 Union Street, Hereford HR1 1BD.

 

Prior to making their decision the Members heard from Mr. Fred Spriggs, Licensing Officer Herefordshire Council, Inspector Nick Semper and James Mooney, West Mercia Police and Mikayeel Deen, the Premises Licence holder.

                                                                                             

Having carefully considered those matters brought before them and in reaching their decision, the Members had full regard to both the provisions of the Licensing Act 2003, the Guidance Issued under Section 182 of the Licensing Act 2003 and the Council’s Licensing Policy.                                                     

 

It referred and gave weight to the appropriate statutory provision, best practice and evidence put before it by all parties.

 

West Mercia Police confirmed that no contact had been made by the applicant since the application to review had been made. They also confirmed that they are not asking for a suspension of the licence but require that correct procedures and conditions are adhered to.

 

The applicant made the point that the business was his lively hood and would lose everything if this was taken away.

 

The Subcommittee `advised the applicant that in future it would be beneficial if he engages at all times with the appropriate police and licensing authorities.

 

RESOLVED

 

It is the committee’s decision that the licence be suspended as such time as a log book of employees completed in all respects is shown to the Licensing Officer. As soon as this is done to his satisfaction the suspension will be withdrawn with immediate effect without the need for a further hearing of this committee

 

With the following reasons given:

 

 

·         Need to ensure future compliance with appropriate regulations and licence conditions.

 

·         Need to ensure log-book fully completed and accurate before suspension lifted.

 

·         Need it to be clear to all licensed establishments of their duties
