To consider an application for an Expedited/Summary licence review of the premises licence in respect of Lyde Court, Lyde Cross, Hereford, HR1 3AE.

The Regulatory Sub-Committee was convened in order to determine an application for an expedited review of a premises licence for Lyde Court, Lyde Cross, Hereford, HR1 3AE. The Review had been applied for by Superintendent Ivan Powell, representing West Mercia Police. The review related to the licensing objective of the prevention of crime and disorder.

 

The Chairman introduced the Members and Officers and asked any interested parties to introduce themselves. The following interested parties were noted:

 

  • Mr Mooney (Representing the Applicant for the Review)
  • Mrs Waring (Premises Licence Holder)

 

The Licensing Officer presented the report.

 

Mr Mooney, representing West Mercia Police who had requested the review, addressed the sub-committee. He advised the Sub-Committee that in the early hours of 2 June 2013, 13 Police Officers had been despatched to Lyde Court following three 999 calls regarding serious disorder at the premises. When the Police arrived at the premises at 0340 hours alcohol was still being served and there were approximately 75 people still on site, this was despite there being a terminal hour for alcohol of 0200 for non-residents. He requested that the DPS be removed and a terminal hour of midnight be introduced at the premises.

 

Mrs Waring, the Premises Licence Holder, addressed the Sub-Committee and disputed the level of disorder and number of patrons on site as referred to by the Police. She also disputed that non-residents were being served alcohol and noted that there had been some confusion by the police as to who the Designated Premises Supervisor was. Mrs Waring produced a number of photographs that the police and the Sub-Committee were happy to accept despite them not being served on all parties prior to the meeting.

 

The Sub-Committee retired to make its decision. When the meeting was reconvened the Senior Litigator read out the decision advising the premises licence holder that four conditions were to be added to her licence as an interim step pending a full review of the premises licence scheduled to take place on 1 July 2013.

 

RESOLVED

 

That the following conditions be attached to the licence as an interim step:

 

1.         That the Designated Premises Supervisor may remain until the full review hearing when a further decision will be made based on the evidence put before the Sub-Committee.

 

2.         That no alcohol be served to residents outside of the currently permitted licenced hours.

 

3.         That SIA registered door staff be employed on a risk assessed basis.

 

4.         That toughened or plastic vessels be used at all functions and that any drinks served in glass bottles be decanted into plastic/toughened vessels prior to serving.
