05/05/2020 - BT consultation on phone box removal spring 2020 ref: 6808    Recommendations Approved

To approve the retaining of 6 at risk public phone boxes, in full working order, in response to a formal consultation by British Telecom (BT). As set out by Ofcom, BT has an obligation to consult with Herefordshire Council with regard to the proposed removals. In some cases, a payphone can still be essential local service, where there is unreliable mobile coverage and in the absence of mobile access.

Herefordshire has positively supported communities to be involved in producing a neighbourhood development plan and currently has the greatest number being produced in a local authority area within England. 

 

There are currently 112 plans being produced in Herefordshire (69 of which have now been Made) by parish councils and their local communities. These neighbourhood development plans will provide more locally detailed policies to support the delivery of the Herefordshire Local Plan – Core Strategy and guide development within the local parish until 2031.

 

On 20 May 2016, the Council delegated authority to the cabinet member infrastructure for decisions on all further neighbourhood development plans adoptions, and consequential amendments to the countywide policies map.

10/03/2020 - Hereford & South Wye Transport Review – Transport Strategy Assessment ref: 6701    Recommendations Approved

A decision was taken 9 August 2019 by Cabinet Member for Infrastructure and Highways to pause all work on the South Wye Transport Package and Hereford bypass and a review of the projects be undertaken to determine next steps. This decision was called in and a General Scrutiny meeting was held 9th September in which recommendations were made.

The Cabinet Member took a further decision 22 October 2019 which took into consideration the recommendations made by General Scrutiny Committee and confirmed a review of the South Wye Transport Package and the bypass project to determine next steps.

On 24 January 2020 the Cabinet Member took a decision to approve the scope, outline programme and timescale for undertaking the review of the Hereford and South Wye Transport Packages, within a budget of £360,000.
The report outlined that the review is essential to ensure that the council’s decision making is fully informed by the latest information and best practice.

06/03/2020 - Capita Schools Information Management System (SIMS) - Annual Maintenance Renewal ref: 6699    Recommendations Approved

The Council holds perpetual rights to SIMS licences and renewing the support ensures that the system is adequately updated, maintained and ensures availability of any system upgrades. This allows the schools to continue to meet DfE statutory regulations in respect of managing their pupil data.

Support and maintenance for this product can only be obtained directly through Capita Business Services Ltd, the proprietor of the software.

The decision to renew the annual maintenance agreement with Capita for a further 12 month period is in accordance with the waiver produced and signed off in April 2019 authorising the current contractual agreement to expire on 31st March 2021.

26/02/2020 - Hereford Enterprise Zone – land transfer to Western Power Distribution and relevant easements for new electricity substation and cables at Shell Store, North Magazine. ref: 6698    Recommendations Approved

Work is underway on the refurbishment of the Shell Store at the Hereford Enterprise Zone. Approval for a new substation was given by the Acting Directory for Economy and Place on 6 June 2019 at a cost of £51,103.82 + VAT.

WPD policy is to acquire freehold for the base of their substations with rights of access to allow them to maintain and repair their assets. However due to an oversight by WPD, a land transfer and wayleave agreement was not put in place before work on the substation commenced. A temporary wayleave was granted but now a land transfer for the substation base is required. This agreement will assimilate the rights previously granted within the temporary wayleave.

Property services have been consulted and have approved the transaction.

28/02/2020 - Re-open the former Hillside Rehabilitation Centre as a residential care home for adults to relieve additional NHS pressures & reduced capacity in the care market caused by flooding in October 2019 & February 2020. ref: 6696    Recommendations Approved

Herefordshire Council is designated as the Lead Local Flood Authority (LLFA) for Herefordshire. This means we have a number of duties and responsibilities in relation to managing flood risk across the count y.

A major flooding event occurred in Herefordshire during the weekend of 15th-16th February 2020, with river levels on the River Wye and River Lugg exceeding the highest levels on record. A major incident was declared by Herefordshire Council on Saturday 16th February.

As a consequence, Herefordshire experienced significant surface water and river flooding, with a large number of properties impacted during February 2020 (many more than flooded in October 2019).
Flooding in February 2020 has compounded problems caused by flooding in October 2019 and has removed from operation two care homes in Herefordshire,

reducing capacity tor resIdentIaI care by l. beds. Other care homes in the county
and around our borders remain vulnerable to flooding, and care homes in neighbouring councils have also flooded. This has put severe pressure on the health and care system and compromised the council's ability to find affordable residential care for vulnerable adults. This emergency action will allow the creation of additional capacity in which to place exclusively Herefordshire residents who require residential care .

The council owns the freehold building currently known as Hillside Rehabilitation Centre situated on Pentwyn Avenue, Hereford HR2 7LB. Until 2018 the centre was operated by Wye Valley NHS Trust (WVT) as a community hospital and currently has 22 en-suite bedrooms with three day rooms, courtyards and onsite parking, however WVT have ceased delivering services from Hillside and the building currently stands empty providing opportunity to swiftly bring the facility back into use.

24/09/2018 - South Wye Transport Package - Southern Link Road (SLR) land acquisitions. ref: 6690    Recommendations Approved

The owner of this parcel of land within the CPO was only prepared to contract with the council prior to the CPO Inquiry on the basis of an outright purchase, unlike all other agreements which have been negotiated and agreed on the basis of an option agreement enabling the council to acquire the land on confirmation of the CPO and SRO or earlier if required. However as this land is located at the eastern end of the scheme and has direct access onto the highway in the event that the scheme does not progress the land is capable of being resold, in the event that the vendor does not exercise their option to purchase back the land. On completion of the purchase the landowner will withdraw their objection to the CPO and SRO.

28/02/2020 - West Midlands Regional Foster Care Framework ref: 6665    Recommendations Approved

To approve the adoption of the West Midlands Regional Foster Care Framework for the provision of foster care services from 1 April 2020 to 31 March 2023; with the option to extend for up to a further year at an estimated spend of up to c.£3.5 million per annum. Actual spend will depend upon demand from the number of children looked after by the council and the capacity of the council’s in-house fostering service to meet that demand.

 

The current framework agreement expires on 31 March 2020 and there is no option to extend.  Sandwell Children's Trust has taken the lead on behalf of the region on a re-procurement exercise for a new framework which is due to go live on 1 April 2020.  Joining the framework ensures that Herefordshire can continue to achieve good value and quality when placing looked after children with independent foster care providers. Joining the framework allows access to a pool of regionally approved fostering agencies. It does not commit the council to spend via the framework. The council will search for placements for individual children via the framework, and will purchase from the framework if a suitable match is found for that child. If a suitable match can not be identified, the council would extend its search to, and may purchase from, the wider market of agencies that have not joined the framework.

(c)  the Director for Children’s and Families and relevant Assistant Directors be authorised to take all necessary operational decisions to spot-purchase placements outside the framework should the need arise for individual children.

24/02/2020 - Decision to deliver safety improvement works along Widemarsh Walk ref: 6684    Recommendations Approved

The walkway has deteriorated with tree route damage to the path and erosion of the banks resulting in significant drops to the brook. The proposed works include for stabilisation of the path, removal of existing redundant concrete fence posts and tree improvement works.

28/02/2020 - Contract award to Cisco Network Maintenance for Equipment Purchased prior to 2017 ref: 6683    Recommendations Approved

Hoople IT has undertaken an exercise to re-procure the support and maintenance contract for Cisco Equipment purchased prior to 2017 including the on-site telephone system (all other devices procured since that date are covered by other support contracts).

The current short-term extension to the incumbent supplier is due to expire 29th February 2020.

The equipment to be covered by this contract is critical to supporting the services that Herefordshire Council provide to the citizen, namely Core Networking and Telephony services.

With this in mind and not to place the Council at risk, it is recommended to award the contract to the new provider from the 1st March 2020 for a period of 3 years with the option of extending for a further 1 year plus 1 year.

In order to demonstrate best value and in line with Herefordshire Council procurement rules, a procurement exercise has been completed via CCS Framework RM3808.

2 responses have been received. Both providers have demonstrated the capability, appropriate accreditations and service contract solutions with the manufacturer.

27/02/2020 - Revised Housing Allocation Scheme for Herefordshire 2020 ref: 6672    Recommendations Approved

To approve the Housing Allocation Scheme for Herefordshire 2020.

 

Under Part VI Housing Act 1996 (as amended) the council is required to have an allocation scheme for determining priorities and providing information on all aspects of the allocation process. This is required even though Herefordshire Council does not have its own social housing stock because it does have nomination rights to a proportion of the properties owned by registered providers (RPs) in the county that become vacant and available for letting.

 

A housing allocation policy was approved by Cabinet in April 2018 but this has not been

implemented due to issues around the required IT support which are identified below. The delay has enabled review and revision of the 2018 policy in the light of further guidance, notably in respect of the Homelessness Reduction Act 2017, and the change in procedures arising from the reversion to a choice based lettings (CBL) scheme.

 

The amendments to the 2018 policy include some changes to the banding criteria, improved clarity on additional preference for armed forces personnel and a band for existing tenants and general applicants. The latter band will not be assessed by the council’s housing register team but will provide a means by which the Registered Providers (RP) can let the percentage of their vacant properties which are not subject to the percentages detailed in the nomination agreements with the RPs. Exclusion and reduced preference has been replaced with suspension from bidding, in the light of recent legal advice. The majority of the amendments however relate to the revision of procedures to reflect the maintenance of a choice based lettings scheme rather than the proposed data transfer and manual nomination process envisaged in the 2018 policy.

 

In order to support the maintenance of a choice based lettings system and to enable

implementation of the revised housing allocation scheme it is necessary to upgrade the IT system procured as part of the service redesign process, in particular to have an improved advertising module with better connectivity and more features to improve the information available to prospective tenants.

To provide assurance that progress is being made towards achievement of the agreed revenue budget and service delivery targets, and that the reasons for major variances or potential underperformance are understood and are being addressed to the cabinet’s satisfaction.

 

The 2019/20 outturn is £51k overspend as at the end of December 2019. It is anticipated that this will be addressed within the directorates.

 

The proportion of performance measures showing an improvement, or remaining the same compared to the same period last year is 70%. This is an improvement on the same period last year.

27/02/2020 - ONe off change to HARC Saturday opening hours in April 2020 ref: 6679    Recommendations Approved

The search room at Herefordshire Archive and Records Centre opens to the public on the second Saturday of each month. In April 2020 this would be on the 11th of the month which is Easter Saturday. Both the day before this (10th) and the following Monday (13th ) are Bank Holidays and the building will be closed although the search room is closed to the public on a Monday anyway.

Anecdotal evidence suggests that many researchers use the Saturday as a ‘bonus’ day and will use the search day over a two day period on a Friday and Saturday when it is open, hence the proposal to move the Saturday opening in April to the following weekend.

The number of service users impacted by any change is likely to be low. The average number of users of the service on a Saturday per month since April 2019 has been 14. Many of these are regular Saturday users so they can be informed during the March Saturday opening session of the change for April.

A decision now also allows time for wider publicity of the change via the website and social media channels.

25/02/2020 - To approve the spot purchase Occupational Therapy assessments from NRS Healthcare Ltd via a contract variation to the ICES contract until 31.03.20 ref: 6678    Recommendations Approved

There is currently a chronic shortage of directly employed occupational therapists in the council which has contributed to a large backlog of outstanding statutory assessments.

In order to address some of the capacity issues, a new approach and structure has been approved to continue to meet our statutory requirements whilst improving the efficiency of the service. This will be implemented from early next financial year.

The backlog of reviews needs to be completed before the new pathway begins in order to ensure a smooth transition period whilst not impacting on delivery.

17/02/2020 - Contract variation for Jadu Limited on website functionality ref: 6675    Recommendations Approved

Jadu Limited provide the website platform for Herefordshire Council with an agreement in place since 2016 – the contract covered creation of the website and on-going licences. To increase the functionality of the website and ease of creating forms then the council have made the decision to purchase the Photon product as a one off cost. In addition Jadu would be able to host the website through an annual fee creating a less resource intensive process for implementing updates. This will have the benefit of reducing staff time of creating a “work around” internally when applying updates with this time able to address other demands of the website in keeping content up to date and meeting the accessibility requirements (WCAG 2.1 AA).
The variation of the contract also allows for an update on data protection requirements, anti-slavery and human trafficking legislation and accessible standards.
The changes to the website will provide more options for the user in creating digital forms to support people’s interaction with the council.

27/02/2020 - Better ways of working implementation ref: 6673    Recommendations Approved

The report is to outline further delivery of the “better ways of working” initiative that enables

employees to work flexibly and to consolidate use of premises. This decision will specifically relate to the future occupancy of the Nelson House building and consider changes to Plough Lane and Elgar House offices to accommodate any increased occupancy of these buildings. The report will include details of any required financial investment and associated savings, details of any required procurement and any guidance to changes to staff working practices that will enable the improved usage of the workspace.

 

As well as consolidating spaces based on cost saving the purpose is the creation of a flexible, modern working environment that can have a positive impact on service delivery and staff morale.  Also, open plan and shared spaces support opportunities for collaborative working can aid communication. With reducing the number of sites the on-going use and cost of utilities can lessen and through encouraging the use of multi-agency offices in the market towns and home working reduces employees’ carbon footprint, including congestion into Hereford.

 

Better ways of working is an initiative that was introduced several years ago and whilst some teams have adopted the approach it has not been consistently applied across the organisation. Due to the proposed reduction in council buildings, associated guidance and policies will need to be more robustly applied with the proposals providing an opportunity to instigate a consistent approach.
