14/11/2019 - Fastershire Broadband Terms of Extension 2019

To approve changes to the Council’s existing broadband delivery contracts with Gigaclear to expand their scope in terms of the level of public subsidy and the number of eligible premises that would be reached with full fibre broadband.

 

Agreeing this change will release an extra £1.89m of existing subsidy to leverage no less than £881k private sector investment and will provide an extra 5,486 premises will full fibre broadband across the two counties of which 872 are currently incapable of accessing superfast broadband. The timescales relating to the current contracts were previously extended through a cabinet member decision in March 2019.

 

To date 90% of premises in Herefordshire can access a superfast broadband service, from a starting point of the Fastershire programme of 0.6% premises in 2012. Fastershire is a partnership between Herefordshire Council (as the lead partner) and Gloucestershire County Council, with capital match funding from national government. The programme uses public funding to create a broadband network where commercial providers are not investing as a way of residents and businesses taking advantages of the digital connectivity.

Explanation of anticipated restriction:
Appendix 1 is exempt from publication by virtue of paragraph 3 of Schedule 12A of the Local Government Act 1972 and it is considered that the public interest in maintaining the exemption outweighs the public interest in disclosing the information. Disclosure in this instance would be indicated by the public interest in the contract because of its financial value and the importance of the service involved. However, there is a clear argument against disclosure in that it would be a clear breach of commercial confidentiality and would risk challenge, given that the procurement process would not be fully completed. Whilst the public interest in disclosure is apparent, the risks arising are significant for the council's reputation and legal position. Therefore, exemption would be justified.

The Youth Justice Plan forms part of the council's budget and policy framework and is reserved to full council to approve.

The plan is produced on an annual basis on behalf of Herefordshire, Shropshire, Telford and Wrekin and Worcestershire councils. The basic plan preparation is undertaken by the West Mercia Youth Justice Service according to the deadlines and content requirements set by the Youth Justice Board for England and Wales (YJB).

The plan sets out how youth justice services across West Mercia are structured and resourced and identified key actions to address identified risks to service delivery and improvement.

Under section 40 of the Crime and Disorder Act 1998, each council has a duty to produce a plan setting out how youth justice services in their area are provided and funded and how the youth offending service for the area is funded and composed, the plan is submitted to the YJB.


The plan for 2019/20 was prepared in May 2019 in line with guidance issued by the YJB. The draft plan was agreed by the West Mercia Youth Justice Service Management Board on 24 May 2019
