Licence to occupy to clean and repair the war memorial at The Prospect Garden Ross to Ross Town Council

1. The Prospect Garden Ross is owned by the council and comprises a formal garden accessed and used by local people as public open space.
2. The war memorial, a grade 11 listed structure situated in a central position in the garden is the focus for Remembrance commemorations in the town and is now in need of cleaning and repair.
3. Ross Town Council are prepared to carry out this work and are following guidance from and seeking funding from the War Memorial Trust and have applied for the necessary listed building consent.
4. The works proposed are necessary to preserve the fabric of the monument, and the Local Authority Building Conservation Department have been consulted to review the works specifications. The works satisfy the requirements of Policy LD4 of the Herefordshire Core Strategy, and relevant National Planning Policy Framework policies; they will also preserve the special architectural and historic interest of the monument as required by Section 66(1) of the Planning (Listed Building and Conservation Area) Act 1990.
5. The licence will be on the basis that all necessary statutory and other consents are fully complied with and all works are carried out to the standard required by the War Memorial Trust and in such a way as to ensure public health and safety
