To approve the proposed expenditure of capital grants for school buildings maintenance works.

 

The Department for Education provides capital funding to local authorities responsible for schools. This funding includes the schools condition allocation which is intended for the maintenance of community and voluntary controlled schools.

 

The distribution of this funding is determined in accordance with the principles set out in the schools capital investment strategy and is based on regular condition surveys.

 

Appendix A provides the details of the schemes being proposed as part of this programme of works.

03/12/2020 - Peterchurch Primary School Rebuild - Developed Design ref: 7383    Recommendations Approved

To approve the proceeding to the next stage of the rebuilding of Peterchurch Primary School, on the existing site, by commissioning a developed design (Royal Institute of British Architects (RIBA) Stage 3) for a traditional and/or modular build.

 

The design brief will include a requirement that the building must achieve net zero carbon emissions and obtain a green building certificate. As a minimum it should receive Passivhaus certification. The developed design will include the coordinated architectural, structural and building services design and updated cost information.

To approve a three month direct award of a contract for accommodation based support service for young people for the period to 31st January 2021.  The contract is due to end on 31st October 2020 and an unavoidable delay has resulted a request for a direct award to extend to 31st January 2021.  Once approved a waiver will be requested.

 

It was proposed that procurement would commence for a new housing related support service for young people in June 2020, with mobilisation aligning with the completion of building works and the end of the existing supported accommodation for young people contract on 31st October 2020, it was planned that the new service would commence on 1 November 2020.

To approve the allocation of highway contributions secured by way of S106 agreement to deliver works through the public realm contract in conjunction with the programed resurfacing scheme approved by the Cabinet Member in April, 2020, as set out in the Public Realm Service Annual Plan 2020/21 report and appendices.

 

These works to be done using S106 monies comprise engineering features and road markings which will change the environment of the village and reduce the speed through the village.(the S106 works)

To approve a variation of the cabinet decision of 30 January 2020 (minute 122 resolution (a)) and approve the tendering and procurement of a building maintenance, small works and cleaning services contractor for a period from 1 April 2021 to 30 June 2023.  The services delivered under this contract are critical to ensuring that the council is able to maintain its buildings in a condition that is safe for community users and staff. This contract enables the council to react to these requirements in a timely and cost effective way. 

 

Under a cabinet decision on 30 January 2020 the building maintenance, small works and cleaning services were to be tendered for a period from 1 September 2020 to 30 June 2023. Due to the Covid emergency the tender process was suspended and a cabinet member decision was taken to grant an extension of the existing contract of one year to enable time for the contract to be re-tendered.

 

The current provider, Balfour Beatty Living Places (BBLP), declared in August 2020 that they would only be willing to provide the service up to 31 March 2021.

 

The relatively short term of this contract will provide a timeline for the completion of a strategic review of property services and subsequent implementation of change subject to approval.

 

The council has a duty of care to ensure the safety of the users of over 100 of the council’s operational buildings such as libraries, offices, children’s centres and schools both visiting public and our staff; this contract enables the council to comply with these duties.

To provide assurance that progress has being made towards achievement of the agreed revenue budget and service delivery targets, and that the reasons for major variances or potential under-performance are understood and are being addressed to the cabinet’s satisfaction. 

 

The 2020/21 forecast outturn is a £15,919k overspend as at the end of June 2020, however the council has been allocated COVID-19 grants of £11,878k from Ministry of Housing, Communities and Local Government. Leading to a forecast net overspend of £4,041k. It is important to note that this forecast is predicated on no further significant expenditure on COVID-19 matters.

 

The proportion of performance measures showing an improvement, or remaining the same compared to the same period last year is 74%; this is an improvement on the same period last year. At the end of the quarter, 49% of actions from the delivery plan are identified as complete or had progressed within planned timescales.

23/09/2020 - Decision to spend from the Estates Capital Programme 2019/22 on replacing Air Handling Units at Plough Lane ref: 7207    Recommendations Approved

The works include the replacement of the existing extract fan which had a
major failure in 2018 causing a significant amount of downtime for the
catering operation. The unit is a number of years old and is located on
the roof of the boiler house on top of the Plough Lane building. The new
location will be on top of the lower flat roof portion above the kitchen
area so will be much easier to access for maintenance/repairs.

The new system will incorporate heat recovery and therefore be more
energy efficient than pulling warm air out of the kitchen and having to
re-heat the area via the radiators.

The works include the replacement of the existing aluminium kitchen
canopy with stainless steel thereby making it compliant with current
standards.

The works have been discussed by the BWOW Project Group and are
required as part of future plans intended to benefit the community.

The council has a skills gap and challenge in recruiting qualified social workers, this is a challenge mirrored nationally. The council therefore has a plan to ‘Grow Our Own’ social workers in both Adults’ and Children’s directorates to address this issue.

The increase in the number of social workers will lead to improved service provision for service users.

As a large employer the council is required to make mandatory contribution to the government apprenticeship levy pot. However, the council is also able to benefit from this levy by accessing Apprenticeship courses funded by the levy.

The Apprenticeship provider draws down the funding directly from the government Apprenticeship levy. The maximum that can be claimed for each Apprentice is £23,000 for the three year Social Work (degree) Apprenticeship programme. The council is seeking to train 21 Apprentices starting in 2021. Therefore, the contract value will be approximately £483,000, which requires an open tender process to procure a provider.

The provider must be registered on the Register of Approved Training Providers to deliver an approved apprenticeship leading to a degree-level qualification in social work.

Central government announced the test and trace support payments scheme on 20 September.

From 28 September there will be a new legal duty on all those who test positive for COVID-19 or are identified by NHS Test and Trace as a close contact, requiring them to self-isolate.

Central government is providing funding for a new Test and Trace Support Payment scheme of a £500 lump sum payment for people on low incomes who are unable to work while they are self-isolating because they cannot work from home.

To be eligible for the Test and Trace Support Payment, an individual must:

• have been asked to self-isolate by NHS Test and Trace either because they’ve tested positive for coronavirus or have recently been in close contact with someone who has tested positive;
• be employed or self-employed;
• be unable to work from home and will lose income as a result; and
• be currently receiving Universal Credit, Working Tax Credit, income-based Employment and Support Allowance, income-based Jobseeker’s Allowance, Income Support, Housing Benefit and/or Pension Credit.

Herefordshire Council will verify eligibility, process applications and make payments.

• Network Performance Monitor – monitors the availability, bandwidth utilisation and other metrics of network equipment
• Network Configuration Manager – backs up the configuration of networking equipment
• IP Address Management – database of the in use IP address space used on the network to avoid duplication
• Voice and Network Quality – Monitor the quality of the network, and the experience of voice over the network.

A further procurement process is not required due to the cost of this upgrade complying with the Councils Contract Procurement Rules in varying a contract and the cost of the upgrade being less than 50% of the original total contract value.

The current Solarwinds contract allows for additional licenses/nodes to be added and this will be done on behalf of Herefordshire and Worcestershire Clinical Commissioning Group (H&W CCG).

The initial upfront cost for this upgrade will be £6,095.25 (exc VAT) with further costs of £1,219.05 per annum until the contract expires (9th December 2022). Total cost for this upgrade will be £8,533.35.

H&W CCG will be paying for this upgrade in total.

The Fastershire project works across Herefordshire and Gloucestershire to commission a broadband network where commercial providers will not invest. Capital funding is provided by Herefordshire Council, Gloucestershire County Council, national Government via BDUK and other sources - in this instance The European Agricultural Fund for Rural Development.

Herefordshire Council is the lead authority for Fastershire and as such, manages all of the procurement activity for the project wherever that activity is targeted across the project area.

The “Fastershire Procurement Outcome for European Agricultural Development Fund” decision of 23/7/2018 laid the foundations for a contract that was awarded to Voneus in November 2018 valued at £712,000 (with a change tolerance up to £940,20 to increase coverage) to deliver 5 clusters in Gloucestershire.

Voneus withdrew from the contract, electing to fund themselves the clusters they won commercially rather than using the available subsidy. Based on legal and commercial advice the funds deemed for Voneus could be reused to reach more premises in the outlined intervention area that were not bid for during the original procurement.

Airband submitted a tender for 4 of the Gloucestershire clusters (G5, G6, G7 and C3 in the Forest of Dean). The submission has passed all of the minimum thresholds and scored 54.63%.

As set out cabinet confirmed the allocation of pothole and challenge fund to highway maintance and confirmed this maintenance would be delivered through the Public Realm contract. This decision sets out what intended works are. If any changes occurred this will be managed through the contract change control mechanism.

The programme of works have been derived from the asset management data and therefore justify investment based on their risk profile.
The public realm services contract with Balfour Beatty Living Places (BBLP), was put in place through a competitively tendered process and the council will ensure its duty to secure best value is met through scrutiny of the cost and quality of the works commissioned with these funds. All works needed are in the scope of the public realm services contract as part of its core services.
Given the imperative for timely action to complete the entire programme of works in 2020/21 and to spend of external grant it was agreed at cabinet and council that these works be commissioned through the public realm services contract. This on the basis that the resources needed to investigate, design and implement the works required are more immediately available to the council, than if other procurement routes were taken.

Resources and management processes are in place to manage delivery through the public realm services contract. These are proven to ensure works are controlled by the established contract management systems and change control processes. If others were used, as is always the case when procuring works through a separate contract, the council would have to identify and assign resources to its management of new contract(s) and the project management of the works as separate, or supplemental, to the management processes and resources that are established for the management of the public realm services contract.

17/09/2020 - Appointment of Hereford Towns Fund Consultancy Support (Rose Regeneration) following completion of the procurement process ref: 7179    Recommendations Approved

In late 2019 Hereford was included within the government’s “Towns Fund” Programme. Through the Towns Fund, Government is working with places to address growth constraints and to ensure the country can chart a course of recovery from the impact of Covid-19. The overarching aim of the Towns Fund is to increase economic growth with a focus on regeneration, improved transport, better broadband connectivity, skills and culture.

Each town in the programme is required to submit a “Town Investment Plan” (TIP) which sets out the vision and strategy for the town and includes a selection of projects that will deliver the vision. There are two phases in the process, with a decision gateway at the end of each. First, towns will develop TIPs, which will be assessed by the Ministry of Housing Communities and Local Government to inform a Heads of Terms offer (given the submission is of sufficient quality). Towns will then develop agreed projects and business cases in detail, and government will assess that information before releasing funding for implementation. This second element of the process is not currently part of the Rose Regeneration commission.

The Hereford Towns Fund Board is a public / private organisation set up to drive the production of the TIP. Its formation was a condition of inclusion on the programme and its membership has been determined on the basis of government guidance. The Board, via Herefordshire Council as the accountable body, wish to appoint a consultant that has experience in delivering similar masterplan and visioning documents, engaging with local communities and preparing a strong evidence base.

There was no application process for selection within the Towns Fund programme and Hereford’s inclusion was a government, rather than local, decision. There was no engagement with the council about the process prior to the announcement of the selected towns and launch of the programme, and neither was there any ability to lobby for the inclusion of other towns within Herefordshire.

Recognising the need to seek appropriate expertise to deliver the TIP by the deadline, the procurement of specialist consultancy support has been undertaken in accordance with the council’s contract procedure rules.

The procurement procedure was a restricted tender process which was issued to five potential suppliers. Three responses were received back and assessed by a panel consisting of four board members from the Towns Fund board plus the Economic Development Manager and Councillor Hitchiner. Rose Regeneration were appointed due to their experience in the field of economic regeneration work including the current production of several Town Investment Plan’s in the east of England. They were also able to demonstrate knowledge and experience of local issues which members on the panel felt advantaged them in terms of understanding the city and its issues which will enable them to swiftly move on the commission.

A small number of residents of Edgar Street, Hereford have no off road parking for their properties. In December 2018 side streets adjacent to Edgar Street were restricted in use to residents only, though this did not include properties in Edgar Street. This has resulted in a severe lack of parking options for these residents.
Available kerb space within zone E has been identified which may accommodate the needs of these residents. However, whilst the impact is expected to be limited, care must be taken to ensure that the inclusion of more residents into this zone it does not create an oversubscription and affect existing zone E users.
An up to six month trail of this change took effect from December 2019, as no issues were reported this have now been made permanent.

Herefordshire Council (the highway authority) has a duty by virtue of Section 130 of the Highways Act 1980 to protect the rights of the public to the use and enjoyment of any highway and to prevent, as far as possible, the obstruction of the highway.

In line with the council’s ‘Overarching Enforcement and Prosecution Policy’ the next incremental and proportionate enforcement action is to serve a statutory notice on the person responsible requiring them to remove the obstruction

14/09/2020 - Variation to public realm annual plan 20/21 - Addition of funding from the Capital Investment in Infrastructure 2020/21 Public Realm Annual Plan ref: 7138    Recommendations Approved

On 6 August 2020 the Cabinet Member for Infrastructure and transport made the following decision:

(a) £2m to be spent in 2020/21 on the U and C road network following resolution at the meeting of the Council held on 14 February, 2020. The proposed delivery programme, following assessment/survey of the whole network, will be confirmed in a further cabinet member report; and
(b) £2m investment in infrastructure capital programme budget is invested and spent as set out below:
a. £380k Drainage works in Lea Flood Alleviation Scheme
b. £300k Drainage investment in capital schemes to alleviate public realm flood sites and damaged / broken assets.
c. £20k Improve signage at gauge boards at known flooding areas and diversion routes such as A438 Letton.
d. £300k Investment in structures.
e. £500k Highway safety scheme.
f. £100k Invest in the Public Rights of Way damaged infrastructure resulting in closed networks.
g. £100k Playground investments.
h. £100k Footpath Improvements.
i. £200k winter fleet investment

This is a separate capital budget to the Annual plan Local Transport Plan capital budget and costs will be reported against the budget line.

The Acting Assistant Director has determined that the most effect way to deliver this additional investment is through the Public Realm Services Contract given that the proposed works are within the scope of that contract.

To achieve this the Acting Assistant Director has decided to use her delegated authority provided by the Cabinet Member Infrastructure and Transport on 29 April 2020 to vary the Public Realm Service Annual Plan 2020/21 by adding these works to the Annual Plan.

Therefore the following will be added to the Annual Plan:

£2,000,000 C & U Roads – the programme is to be derived from information gained from current Visalia surveys and will be the subject of a further decision by the Cabinet Member and adjustment to the Annual Plan by the Acting Assistant Director.
