However, pursuing the defence of the reasons for refusal by the Council could be seen as unreasonable given there is no technical evidence to support the grounds for refusal. It should also be noted that the Council is having difficulty securing technical experts who would provide their evidence in support of the Council’s decision to refuse the planning application.

Regrettably, the legal advice of the Solicitor to the Council and Monitoring Officer is to withdraw the ‘reasons for refusal’ given by the Planning Committee on 11th December 2019 to both mitigate the reputational damage to the Council and to limit the significant costs that the Council could incur.

It is likely that the Inquiry will still take place however the Council will withdraw its reasons for refusal. The benefit of agreeing to withdraw the reasons for refusal now is that the Appellant’s costs incurred in the appeal should be significantly reduced, the inquiry should be shorter, some expert witnesses may not be required to attend and the Council’s costs incurred in instructing technical experts will be reduced

Approval of the contribution towards playground improvement works at Trinity Primary School. A total contribution of up to £20,000 against a scheme cost of £52,430.

The 2018/19 Corporate Accommodation Capital Budget included £90k to
carry out basic alteration works at Leominster Multi Agency Office. Herefordshire Council is designated as the Lead Local Flood Authority (LLFA) for Herefordshire. This means we have a number of duties and responsibilities in relation to managing flood risk across the county.

A major flooding event occurred in Herefordshire during the weekend of 15-16 February 2020, with river levels on the River Wye and River Lugg exceeding the highest recorded levels on record. A major incident was declared by Herefordshire Council on Saturday 16 February. Severe weather warnings remain in place for the River Wye at Blackmarston, and the River Wye and River Lugg in Hampton Bishop, meaning that there is a danger to life. Water levels are expected to remain high for several days. We are still awaiting government announcements regarding support for people and businesses affected by flooding in February 2020.

Therefore the council is going to offer grants to the homes and business affected. We will adopt the eligibility and funding to households and businesses affected by the severe weather that Government provides under the Flood Recovery Framework. This would consist of a Community Recovery Grant, equivalent to £500 per eligible household, to help communities with their immediate recovery and a Business Recovery Grant, which will provide up to £2,500 per eligible small and medium-sized business.

The Local Land Charges office is a statutory service responsible for the maintenance of the Local Land Charges Register and the completion of Local Land Charge searches.

Local Land Charges are imposed on the owners of land and can be originated by local authorities, Highways Agency, Historic England, Water Authorities etc. They affect the current owner and any subsequent owners.

Examples of local land charges originated by the LA are conditions imposed in a planning permission, Conservation Areas, Enforcement Notices, Tree Preservation Orders and Financial charges – e.g. works carried out by the council to make buildings safe.

In addition to the registerable charges, the Council also replies to a number of enquiries set out in a form agreed by the Law Society and the Conveyancing fraternity and this will reveal e.g. adoption of roads, nearby road/traffic schemes, pending planning matters etc.

The fees for local land charges have not been increased since 2017 as part of a three year circle of fee and income review. The charges are calculated on a cost recovery basis based on the length of time taken to complete all searches during a two week period. Taken into consideration is the need for charges to remain competitive and fair.

To review progress against the Safeguarding and Family Support division improvement plan 2019 / 2020 produced in response to the Ofsted Inspection of Local Authority Children’s Services (ILACS) inspection judgement of June 2018 and the subsequent focused visits carried out in 2019.

That the council agrees to grant a new long leasehold to Ascalon for 441.4 sqm of land at Chapel Road, to run concurrently with their existing long leasehold of adjacent land. In addition 34.1 sqm of land will be released from their existing lease back into council’s control
