Regrettably, the legal advice of the Solicitor to the Council and
Monitoring Officer is to withdraw the ‘reasons for
refusal’ given by the Planning Committee on 11th December
2019 to both mitigate the reputational damage to the Council and to
limit the significant costs that the Council could incur.
It is likely that the Inquiry will still take place however the
Council will withdraw its reasons for refusal. The benefit of
agreeing to withdraw the reasons for refusal now is that the
Appellant’s costs incurred in the appeal should be
significantly reduced, the inquiry should be shorter, some expert
witnesses may not be required to attend and the Council’s
costs incurred in instructing technical experts will be
reduced

To confirm how the implementation of the Public Service Vehicle Accessibility Regulations 2000 (PSVAR) will be managed and its long term implications for home to school and college transport in the County.
The council provides statutory free transport services for entitled mainstream school pupils in accordance with the school transport policy. A vacant seats scheme is also offered that enables pupils who are not entitled to free transport to pay to travel on the coach. This is a discretionary service and parents/guardians are notified that seats can be withdrawn with a minimum of one week's notice. Additionally discretionary services are provided to college students, and students attending faith schools in return for payment of an annual fare charge. All students travelling using a paid scheme pay the same annual charge.
Since 1 January 2020 school and college students paying a fare have had to be transported on buses and coaches compliant with the PSVAR, a compliant vehicle being one which is fully wheelchair accessible. Services carrying only entitled students traveling for free are exempt. Although it is the individual operators' responsibility to ensure compliance with the PSVAR, as the commissioner, the council has a duty to ensure that the services it commissions are operated legally and in accordance with all applicable regulations.
Extensive work was undertaken to ensure compliance with legislation by 1st January 2020 however it was not possible to make all services compliant or seek appropriate exemptions by this date and there remained 252 passengers traveling on 7 different services who would have been traveling on non-compliant services on the 1st January 2020. Of the remaining in scope services 23 have been confirmed as being compliant and a further 8 have been granted a 2 year exemption certificate from 1st January 2020. As an interim measure a decision was taken in December 2019 to provide free transport to these students for the Spring academic term, January to April 2020. This follow up report sets out options for managing services for the Summer academic term 2020 and longer term.
Details of the previous decision taken can be viewed here. It is proposed that free travel be extended to include the summer term 2020 such that where it has not been possible to move to compliant services or seek an exemption, students' education will not be disrupted in the final term of the academic year. This comprises up to 252 students travelling on 7 services. However, further retendering of non-compliant services during the spring term is likely to significantly reduce these numbers and the financial implications resulting from lost fares.
It is proposed that the vacant seats scheme and other discretionary transport where a fare is charged is withdrawn from September 2020 where services remain non-compliant. Advance notice will be provided before the end of the current academic year such that parents, schools and colleges will have sufficient time to make alternative arrangements for access school.

Herefordshire Council is designated as the
Lead Local Flood Authority (LLFA) for Herefordshire. This means we
have a number of duties and responsibilities in relation to
managing flood risk across the county.
A major flooding event occurred in Herefordshire during the weekend
of 15-16 February 2020, with river levels on the River Wye and
River Lugg exceeding the highest recorded levels on record. A major
incident was declared by Herefordshire Council on Saturday 16
February. Severe weather warnings remain in place for the River Wye
at Blackmarston, and the River Wye and River Lugg in Hampton
Bishop, meaning that there is a danger to life. Water levels are
expected to remain high for several days. We are still awaiting
government announcements regarding support for people and
businesses affected by flooding in February 2020.
Therefore the council is going to offer grants to the homes and
business affected. We will adopt the eligibility and funding to
households and businesses affected by the severe weather that
Government provides under the Flood Recovery Framework. This would
consist of a Community Recovery Grant, equivalent to £500 per
eligible household, to help communities with their immediate
recovery and a Business Recovery Grant, which will provide up to
£2,500 per eligible small and medium-sized business.

The Local Land Charges office is a statutory
service responsible for the maintenance of the Local Land Charges
Register and the completion of Local Land Charge searches.
Local Land Charges are imposed on the owners of land and can be
originated by local authorities, Highways Agency, Historic England,
Water Authorities etc. They affect the current owner and any
subsequent owners.
Examples of local land charges originated by the LA are conditions
imposed in a planning permission, Conservation Areas, Enforcement
Notices, Tree Preservation Orders and Financial charges –
e.g. works carried out by the council to make buildings safe.
In addition to the registerable charges, the Council also replies
to a number of enquiries set out in a form agreed by the Law
Society and the Conveyancing fraternity and this will reveal e.g.
adoption of roads, nearby road/traffic schemes, pending planning
matters etc.
The fees for local land charges have not been increased since 2017
as part of a three year circle of fee and income review. The
charges are calculated on a cost recovery basis based on the length
of time taken to complete all searches during a two week period.
Taken into consideration is the need for charges to remain
competitive and fair.

To agree the approach to allocating additional budget of £275k for 2019/20 towards additional support for local community transport initiatives and local solutions to maintain access in rural communities noting continuing financial pressures on support for the conventional bus network.
The details of the grant programme have been developed in the context of the 2017 passenger transport review which included extensive consultation and following discussion with local community transport providers. Criteria for accessing the grant will ensure that projects which will support older people, people with disabilities and rural residents without access to private car or public transport are prioritised.
The original decision to provide additional funding indicated that this should be to establish a grant for the purchase of new accessible vehicles for community transport providers. The recommendation is to support a broader range of projects and for it to be made available for a wider range of community groups, with community transport providers being given first opportunity to submit bids. This approach was developed following discussion with community transport providers during which they indicated that they could improve their services if the funding could be allocated for a broader range of activities including:

Whilst the proposed approach will give community transport providers the first opportunity to bid for grant funding it also allows for further rounds to be opened up to other community groups. This will be subject to funds being available after the first round. This is proposed as it reflects the findings of the passenger transport review that other community groups including parish councils and other local charities can play an important role in supporting local access and will add to the overall capacity of the grant programme.
