Agenda item 4 – Councillor Polly Andrews declared that the premises were in her Ward but that she had had no contact with the applicant. 

Agenda Item 5 - Councillor Alan Seldon declared that he was familiar with the site and building when it was previously Richards’ School.

Agenda item 7 – the legal adviser to the sub committee declared that she had advised the council on the purchase of the Royal National College site and the applicant is a tenant of that site and she was advising the council on the building of student accommodation

Agenda item 7 – Councillor Paul Andrews declared that he had a relative who worked at the Folly Lane but has no connection with the premises licence application at the College Road site.

The Technical Licensing Officer, presented the report.

 

In the absence of the person who had made the relevant representation, the sub-committee heard from the applicant.

 

Mr Otieno, Counsel, stated that the applicant was willing to comply with the conditions requested by the relevant authorities.   In his opinion, the application therefore complied with the licensing objectives.   Mr Otieno appreciated that because there had been a public representation, there was a tension between allowing the business to grow and the promotion of the licensing objectives.  

 

With regard to the public representation, the issues raised with regard to the prevention of crime and disorder objective, the agreed conditions had dealt with this issue.    The representation with regard to noise nuisance had been dealt with by way of conditions agreed with environmental health and trading standards. 

 

With regard to the claim that the premises did not employ local people, this was not true and local people were employed.   

 

There was a balance to be struck between enabling a business to prosper and promoting the licensing objectives. 

 

The chairperson of the licensing sub-committee stated that the public relevant representation contained some fundamental errors and he would urge that anyone who wished to make a representation to ensure that they were correct and accurate. 

 

The legal advisor to the licensing sub committee received clarification that the non standard timings for the licence were

 

0200 hours Christmas Day

0200 hours 27th December

0200 New Year’s Day

 

The sub-committee received further clarification from the Licensing Authority that the non-standard timings on the licence when issued would read.

 

09:00 – 02:00 Christmas Eve, Boxing Day and New Year’s Eve.

 

DECISION

 

The sub committee’s decision is to grant the licence with the agreed conditions. 

 

REASONS

 

The sub committee had carefully considered the written public relevant representation in the absence of the member of the public who had submitted it.   The sub committee had listened to and considered the representation made by the applicant and were satisfied that the agreed conditions met the requirements of the four licensing objectives.

To consider an application for the grant of a premise licence in respect of Hereford College of Arts, College Road, Hereford. HR1 1EB.

The Technical Licensing Officer, presented the report.

 

In the absence of the members of the public who had made relevant representations, the sub-committee heard from the applicant.

 

The Finance Director for Hereford College of Arts, made the following points in relation to the application:

 

·      Wider social interaction was a part of the student experience.

·      A student bar had been requested by students for a number of years.

·      Temporary event notices (TENS) had been used as part of a pilot programme since June 2018. 

·      During the pilot period there had been no noise or anti-social behaviour complaints.   

·      With regard to the hours requested, the college were not planning on opening for all the hours, they wishes to have some flexibility. 

·      The college believed that the noise nuisance complaints were in relation to another premises which were not connected to this application.  

·      The college would be happy to meet with any of the people who had made representations.

 

Following questions from members of the sub-committee, it was clarified:

 

·      That some of the representations would seem to relate to a premises not related to the application.

·      Environmental protection had not received any complaints in connection with the TENS events held by the college. 

·      Environmental protection had no record of any noise complaints in relation to that site. 

 

DECISION

 

The sub committee’s decision is to grant the licence with the agreed conditions.
