These are additional contracts required to provide statutory school transport. The net effect of tendering these contracts will see an increase in SEN transport contracting costs of £381.60 in the current financial year.

That:

(a)  the stage two submission for the development of student accommodation on Station Approach (appendix 2) be approved and that a 125 year lease with a mutual break option at 50 years be granted to the external finance provider for a premium of £677,300 to enable the construction of student accommodation on the Station Approach site;

 

(b)  the Project Criteria approved by cabinet on 13 December 2018 for the project to provide student accommodation on Station Approach, are confirmed as having been met as detailed at paragraph 12; and

 

(c)  funding for the project be provided by M&G Investments with the council acting as guarantor during the operational phases. The Chief Finance Officer has completed legal and financial due diligence on this funding option, including the selection of a preferred funder and the negotiation of final terms, and confirmed that the funding model delivers for the council:

i.              a capital receipt for the leasehold interest in the site that reflects the best consideration that can reasonably be obtained; and

ii.            a best value solution for the project which meets the Project Criteria;

 

(d)  the council enter into the Nominations Agreement for a period of 50 years as guarantor to Hereford College of Arts and in the first three years of the Nominations Agreement to provide nominations of students to occupy the student accommodation on the Station Approach site; and authority be delegated to the acting Director for economy and place, following consultation with the Cabinet member contracts and assets and the Chief Financial Officer, to enter into all necessary legal agreements and/or the giving of securities or guarantees and take all operational decisions necessary to implement the above within the approved budget.

To award a letter of intent to Morgan Sindall for the design and construction of the new permanent accommodation and additional on-site car parking at an initial cost of £744,856 plus associated client contingency and professional fees. A total cost up to the value of £800,000. This will cover:
• The design to be completed in detail and the full works agreed
• All necessary surveys to be undertaken
• The creation of a south car park with associated drainage and attenuation
• The widening of the entrance to the south side of the site
• Internal remodeling to create an additional classroom required for September 2019
• Conversion of an attic space to provide a staffroom (the existing staffroom is required for an additional classroom)
• The creation of netball courts by infilling the existing cycle track
• Morgan Sindall enabling works and preliminaries

The costs for the design and surveys were included in a previous record of officer decision dated 24 September 2018. This authorized expenditure up to £250,000. This decision is to authorize the additional spend required to cover the extra items of work pending the signing of the main contract, that is, an additional £550,000.

The full cost of the scheme will be signed off at a later date once the design has been completed. A further officer decision under the delegated powers granted to the director of children’s wellbeing by cabinet will be required to sign off the full contract.

The design consultants selected and engaged by Morgan Sindall are Quattro Design Architects, who were architects for the recently completed Colwall Primary School new build.
