In order to establish whether the current contract remained value for money, a compliant procurement exercise was undertaken through CCS Framework RM3808 Lot 3 where an evaluation of all appropriate catalogue items was conducted.

15/05/2020 - Award of SEN Transport Contracts – April 2020 (Ref 0420) ref: 6874    Recommendations Approved

To ensure that the council manages its transport services effectively whilst also meeting its statutory duties and ensures children are transported to school in line with eligibility.

The previous contracts which were in place to support these educational facilities terminated at the end of the Spring Term 2020. Noting that the council needs to be prepared for potential school re-opening during the current term it is important to have these contracting arrangements in place so that transport will be provided if required.

Development of a ‘call off’ contract was undertaken with advice from procurement officers and reflects the sporadic nature of school transport demands relating to these specific educational facilities. These demands result from referrals of individual pupils in relation to educational, health and wellbeing needs and can occur at any time and not necessarily conforming to fixed school terms. Transport eligibility in these cases results from the referral requiring the child to attend one of a small number of special educational facilities which in many cases is not their nearest school nor within the statutory walking distance.

15/05/2020 - To defer food standards, food hygiene and feed hygiene visits from 20 March until 17 April 2020 ref: 6872    Recommendations Approved

The Food Standards Agency has sent a communication to all authorities after obtaining approval from the Parliamentary Under Secretary of State for Health, Jo Churchill, to permit deviations from the direction given to local authorities in the Food Law Code of Practice (England) and the Feed Law Code of Practice (England) – the Codes.

Deferral of planned interventions

Until 17 April 2020, all planned feed, food hygiene and food standards interventions should be deferred. This will ensure that footfall in feed/food business establishments is kept to a minimum and will enable local authorities to divert potentially diminished resources to urgent reactive work – see below - and to other wider public health actions required locally during the COVID-19 pandemic. Our direction on this is in line with Section 5.3.6 of the Food Law Code of Practice (England) and Section 5.3.9 of the Feed Law Code of Practice (England). We will notify you if the position changes before 17 April and, at any rate, will update you on what the position will be post 17 April.

Local authorities should also defer any requested FHRS re-inspections.
When it is feasible to resume planned inspections, it will be important to apply a risk based approach to outstanding inspections prioritising the highest risk establishments.

15/05/2020 - Funding to support young carers during the coronavirus outbreak ref: 6871    Recommendations Approved

Herefordshire Council will allocate a limited budget of up to a maximum of £5,000 in order to support young carers during the coronavirus crisis. This has been sourced from an existing young carers grant (£20,000) which was originally intended to fund additional carers support groups in Herefordshire. Given the current coronavirus pandemic, the council have been considering alternative ways of supporting young carers in a more flexible way.

All funding allocations will be expected to support young carers during the coronavirus pandemic in light of the restrictions in accessing support and social opportunities, including young carers clubs. The funding will provide:
- an opportunity to talk to and share experiences, skills and advice (via online tools);
- the opportunity to learn new skills for themselves as well as for the person they care for
- the chance to have a break from their caring duties and have fun, preventing isolation.

Need will be identified through the Young Carers Support Service (YCSS) in the Herefordshire Early Help Team and will be approved by the Early Help Manager.

12/05/2020 - Relocation of distribution hub for PPE (personal protective equipment) – Covid 19 ref: 6869    Recommendations Approved

Based on a previous decision (link) the council has agreed to provide PPE to ensure the safety of council staff against Covid-19. The provision also includes distribution to care providers who are unable to access PPE through their usual supplies due to a significant increase in demand largely caused by the NHS/PH adoption of ‘Table 4’ standard of PPE, which is a much higher level of requirement. The intense requirement for PPE is likely to be required for at least the next 12 months, and potentially much longer than this.
A decision was also previously made to set up an emergency delivery hub for distribution of PPE along with food supplied to people shielded (link). That was a temporary location that met all the essential requirements at short notice (e.g. space for social distancing, wifi, good road network for deliveries). However, this was not a long-term venue as its primary purpose is for leisure and a hire charge was required to cover costs. Also, the food delivery element will no longer be needed from 29th May as that operation will cease to be replaced by volunteers supporting individuals and government food parcels.
A longer term solution has been found which can accommodate PPE store and distribution. Site improvement works of up to £25k is required, including:
• Shelving
• Wifi
• Make good office accommodation
• Enhanced security
• Printer connection
• Removals of existing service

Part of the site is a store for council furniture which needs to be removed. It is of poor quality and previously offered to a community group but was not suitable. Consequently the decision is to dispose through reclamation.

The Food Standards Agency has sent a communication to all authorities after obtaining approval from the Parliamentary Under Secretary of State for Health, Jo Churchill, to permit deviations from the direction given to local authorities in the Food Law Code of Practice (England) and the Feed Law Code of Practice (England) – the Codes.

The permitted deviations are time bound for a period of up to 12 weeks from 18 April 2020 (to 17 July 2020).

The permitted deviations to the Codes will help minimise regulatory footfall in business establishments and enable local authorities to divert potentially diminished resources to urgent reactive work and other wider public health actions required locally during the COVID-19 pandemic. They take account of central government advice on COVID-19 and aim to ensure food safety and the protection of public and animal health during the pandemic.

The Local Authority is still required to take action in relation to the following establishments:

High risk establishments where an intervention is due – this includes where:
- food hygiene interventions are due for Category A and B establishments
(prescribed frequency of 6 and 12 months respectively)
-food standards interventions are due at Category A establishments
(prescribed frequency 12 months)
-feed interventions at Category A establishments
(prescribed frequency 12 months)
Establishments still trading where enforcement revisits are due
New businesses – where registration information provided raises concerns
about a potential public or animal health risk
Businesses notifying the local authority of a change in activities

In these cases, the intervention should initially be undertaken remotely - a telephone discussion and paper-based audit of relevant documentation.
If the discussion or documentation provided suggests that there may be a serious public health risk, an onsite visit should be made to asses and address these risks.

Where an onsite visit is not deemed necessary, such interventions will be considered as surveillance and should be recorded as such on the local authority management information system. This will ensure that a planned intervention will remain due

The Local Authority should continue to focus on urgent reactive work to address potentially serious public and animal health risks relating to food/feed. This includes the following:

• Following up on food or feed incidents
• Investigating foodborne disease outbreaks
• Following up on any intelligence of change in food or feed business activities that suggests a potential public health or animal health risk
• Proactively checking businesses with Food Hygiene Ratings of 0, 1 or 2 (less than broadly compliant) to verify if they are trading and if they have started to operate delivery services or have introduced new processes to enable them to diversify their menu
• Proactive surveillance of local changes, such as setting up of community groups preparing meals, or established businesses changing what they do, such as pubs providing takeaway food

In all cases, follow up or investigation should initially be undertaken remotely - - a telephone discussion and paper-based audit of relevant documentation.
If the discussion or documentation provided suggests that there may be a serious public health risk, an onsite visit should be made to asses and address these risks

• Layby traders will provide an outlet for keyworkers travelling to and from their place of work, as well as HGV, van delivery drivers etc

The decision has been taken due to the unprecedented threat to Public Health posed by the outbreak of COVID-19

The current policy requires a taxi driver to obtain from their GP, a completed D4 Medical (same standard as for Bus and Lorry drivers). This is sent to our Occupational Health Doctor who decides if a driver is fit to drive a taxi and what period should pass prior to a further medical being required

Due to the current crisis, it is proving impossible for drivers to obtain medicals from their GP’s or private medical companies, who are not carrying out this function at the present time

The decision is in line with the DfT decision (17th April 2020) concerning bus and lorries drivers

In order to effectively manage the councils highway network in respect of parking, occasionally a Penalty Charge Notice needs to be issued to a vehicle. Where payment is not made in respect of these the relevant legislation provides for debt to be pursued.

In order for the council to continue to exercise its public duty, and recover all associated costs with the enforcement of parking contraventions, and to ensure that the principles of enforcement are not undermined, it is appropriate to take all legal and necessary steps to obtain payment.

The purpose of this Order is to stop vehicles over 7.5 tonnes from using these streets purely as a cut-through; thereby directing such vehicles along the B4203 Sherford Street and Station Road and thus away from the residential streets and town centre streets.

12/05/2020 - Further Warm Homes Funding- Shropshire Council led project ref: 6823    Recommendations Approved

This report seeks approval for the council to participate in an extension to the current Warm Homes Fund project which will support an additional 200 plus fuel poor households in Herefordshire to access funding for first time central heating systems and energy advice through the project.

 

The original decision, made in December 2018, can be found here and approved the proposals for Herefordshire to act as accountable body and add the relevant funding to the capital programme, define eligibility as per 3 and 4 below and for the Acting Assistant Director for Regulatory, Environment and Waste Services to take operational decisions necessary to implement the project.

 

As the additional funding offer requires a change to the current delivery model, this report also seeks authority to vary our current agreement with the Warm Homes Fund and to establish a collaborative governance structure with Shropshire Council who will act as the accountable body.

(a)       Herefordshire Council participates in the Shropshire Council led category 1 (Urban) and category 3 (Energy efficiency and Health related solutions) Warm Homes Fund projects and accepts the grants via the signing of a Memorandum of Understanding;

(b)       The Acting Assistant Director for Regulation, Environment & Waste Services be authorised to take all operational decisions necessary to enable the project; , such as signing off the project Memorandum of Understanding (MoU) and any relevant targeting activity;

(c)       Herefordshire Council agrees to end its current, direct Category 1 agreement with Warm Homes Fund provider, Affordable Warmth Solutions, by means of a variation in the agreement, in order to access the further and higher level of funding provision.

To recommend that the Acting Assistant Director of Highways and Transportation endorses a proposal not to change the speed limit on either the A4137 or B4521 at St Owens Cross, Herefordshire.
The extents of the study area are shown in Appendix A.

The recommendation is proposed for the following reasons:

• The A4137 through St Owens Cross does not meet the minimum density required to be considered for a 30mph village speed limit, as set out in the Department for Transport (DFT) Traffic Advisory Leaflet Circular 1/04 “Village Speed Limits”.

• The surveyed speeds are too high for the enforcement of a 30mph limit according to Association of Chief Police Officers Guidance.

• There is no practical or prominent location for any new speed limit terminal signage at the crossroads.

• It would be more prudent for the undertaking of further safety investigations by Hereford Council’s Accident Investigation and Prevention team.
