Members of the regulatory sub committee considered the application for a variation to a premises licence in respect of Golden Galleon, full details of which appeared before the Members in their agenda and the background papers.

 

Prior to making their decision the members heard from Emma Bowell, technical licensing officer and Fred Spriggs, licensing officer.   Members also heard from the Mr Roderick Blain (applicant’s solicitor) and the applicant.

 

With the approval of all attendees, a photocopy of where the Golden Galleon was situated on Commercial Road was circulated.  

 

During the discussion of the application, it was noted:

 

·         The applicant had been involved in the business for 20 years, first as a manager and then as an owner;

·         The application was to vary the licensable activities until 0330 hrs on Fridays and Saturdays which would be an extension of 30 minutes from the current licence.

·         The premises already had a licence to be remain open until 0430 hrs on the Friday, Saturday and Sunday preceding bank holidays which had not resulted in any issues being reported.

·         The purpose of the Licensing Act 2003 was to stagger closing times and that there would be a commercial advantage to the applicant by approving the extension of hours.

·         The conditions attached the current licence would equally apply to the variation and there was no evidence that the conditions in place had failed to support the licensing objectives.

·         Munchies had the only licence for to sell hot food until 0330 hrs which caused a congregation of people as they were queuing to be served.  By approving the licence, it would increase the efficiency of serving people and they would disperse more quickly.

·         There were two night clubs in close proximity of the shop and they were more likely to be the cause of crime and disorder.

·         That while the SIA door supervisors do not have the authority to act outside of the property, they can act as good citizens.  

·         M&G Wines and Wok and Rice were currently closed due to refurbishment but would be re-opened in due course.   Both premises had a licence allowing licensable activities until 0130 on Fridays and Sundays.

DECISION

 

It is the committee’s decision that the application should be granted.  

 

The committee wished to clarify that the existing conditions would apply to the licence as varied and that in relation to condition requiring the use of SIA door supervisors (attached to the licence following the hearing on 1 October 2015) SIA door supervisors would be required on every Friday and Saturday from 0130 until the termination of licensable activities and on every Sunday preceding a Bank Holiday from 0130 until the termination of licensable activities.

Members of the regulatory sub committee considered the application for a new premises licence in respect of Mila, full details of which appeared before the Members in their agenda and the background papers.

 

Prior to making their decision the members heard from Fred Spriggs, licensing officer.   Members also heard from the Mr Patrick Burke (applicant’s agent) and the applicant.

 

As the only outstanding issue was in relation to whether or not the landlord had signed the licence to assign, the meeting was adjourned for 30 minutes to allow the applicant to obtain this proof.

As the licensing authority had now received the outstanding information, the report was withdrawn from the agenda.
