TO CONSIDER AN APPLICATION FOR A NEW PREMISES LICENCE IN RESPECT OF 'FLANESFORD PRIORY, GOODRICH, ROSS on WYE, HR9 6HZ' - LICENSING ACT 2003. pdf icon PDF 123 KB

To consider an application for a new premises licence in respect of ‘Flanesford Priory, Goodrich, Ross on Wye, HR9 6HZ’ – Licensing Act 2003.

The Sub-Committee considered an application for a new premises licence in respect of Flanesford Priory Goodrich.

The Chairman read out the guidance notes and asked all parties to introduce themselves.

An officer from the Licensing Authority presented the report and drew members’ attention to the two cases stated within it, namely Daniel Thwaites Plc v Wirral Borough Magistrates’ Court and Bristol Council v Bristol Magistrates’ Court.

The Sub-Committee heard from Ms Janet Sheldon a local resident who had made representation against the application.  She informed the Sub-Committee that music could not be heard from inside the main building of Flanesford Priory; however, music could be head from marquees situated within the grounds.  Ms Sheldon drew members’ attention to Item 8 of the Local Authority representations as presented which stated that ‘Noise’ from the premises must not be ‘audible or discernable’ within any occupied permanent structure where people normally reside or sleep. In view of this Ms. Sheldon suggested some restrictions on marquee events.

 

The Sub-Committee heard from Mr Nigel Roper the applicant.  Mr Roper confirmed the following points:

·        Long term aim is to not to continue with the marquee and to hold all events in doors.

·        No plans to use the marquee 365 days per year with around 10 to 16 events forecasted for the marquee.

·        Marquee events would not be restricted to weekends only.

 

In response to a question from the Sub-Committee Mr Roper confirmed the location of the marquee on the map included in the presented report and confirmed that this location would not change.

In response to a question from the Sub-Committee the Licensing Officer confirmed that there had been no noise complaints received in relation to Flanesford Priory.

The Sub-Committee retired to make its decision. When the meeting was reconvened the Chairman advised all parties that the Sub-Committee had decided to grant the Premises licence subject to amendments to the agreed conditions.

 

RESOLVED

 

That the application be granted subject to the following amendments to the agreed conditions.

 

Condition 16:

Noise or vibration shall not emanate from the Premises, that is to say Flanesford Priory, as to cause a nuisance.

 

Condition 17:

Any speakers used for amplification within the marquee as shown on the plan edged in red will face the adjacent built premises, i.e. Flanesford Priory.
